Terms of Sale

These Terms of Sale ("Terms") apply to the purchase of MexxBot welding cobot systems and related goods and services from Mexx Engineering Pty Ltd (ABN 58 121 994 563) ("Mexx", "we", "us", "our") through the website mexxbot.com.au, including any reservation deposit you pay online. By paying a deposit or placing an order, you agree to these Terms.

1. Our products and quotes

The MexxBot system comprises an ABB collaborative robot, a Kemppi welding power source and a controller mounted on a plinth, together with any welding tables, tooling kits and services you select. Prices shown on the website, including any figure produced by the online configurator, are indicative estimates in Australian dollars (AUD) and are exclusive of GST unless expressly stated otherwise. GST is added at the applicable rate.

A configurator estimate is not an offer capable of acceptance and does not create a binding contract. A binding contract is formed only when Mexx issues a written order confirmation or tax invoice for your system.

Early-order pricing is available for orders placed before 31 July 2026 and may be withdrawn or changed at any time before an order is confirmed.

2. Reservation deposit

To reserve a build and hold your price, you may pay a deposit of $2,000 plus GST ($2,200 total) online. Payment is processed securely by Stripe; the deposit reserves your place in our production schedule and the configured price.

Deposit refunds. Your deposit is fully refundable at any time before Mexx places the parts order with ABB and Kemppi. Once those parts have been ordered, the deposit becomes non-refundable, but is credited in full to your final invoice.

3. Payment stages

Unless otherwise agreed in writing, payment for a full system is made in stages:

Goods are not released, and risk does not pass, until cleared payment of all amounts due has been received.

4. Prices, GST and tax invoices

All prices are in AUD and exclusive of GST unless stated. GST is added at the applicable rate, and your Stripe receipt and our invoices are issued as valid tax invoices showing GST separately.

5. Delivery, freight and Ex Works

Goods are supplied Ex Works our Arundel, Queensland factory. This means responsibility for the goods, including freight and insurance, passes to you when the goods are made available for collection at our factory.

Freight figures shown on the website are indicative estimates only and are confirmed on your invoice. You may arrange your own freight, or we can arrange freight on your behalf at cost.

You may optionally select our Delivery + Setup & Operator Training Day ($1,950 + GST) for locations within 100 km of our Arundel factory, which includes delivery, positioning, power-up, test welds and one 8-hour operator training day. For locations beyond 100 km, travel is quoted separately.

6. Lead times

Indicative lead times are based on information from our suppliers and may change. We are not liable for delays caused by suppliers, freight carriers, currency movements, or events beyond our reasonable control. We will keep you informed of any material change to your expected delivery.

7. Title and risk

Risk in the goods passes to you when they are made available Ex Works at our factory. Title in the goods remains with Mexx until we have received payment in full of all amounts owing for those goods.

8. Installation, safety and compliance

The MexxBot is a collaborative system designed to operate without fencing in many applications. A site-specific risk assessment is required before operation to confirm that your particular application can run safely. Unless you have engaged our Setup & Training service, you are responsible for the safe installation, risk assessment, operation and compliance of the system at your site, including providing suitable power, ventilation and any required site preparation.

9. Warranty and the Australian Consumer Law

The robot and welding components carry the manufacturer warranties provided by ABB and Kemppi respectively, on those manufacturers' terms. We will pass on the benefit of those warranties to you.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. To the extent permitted by law, and subject to those guarantees, our liability for a failure to comply with a guarantee is limited to repairing or replacing the goods, resupplying the services, or paying the cost of doing so.

10. Cancellations and changes

You may cancel your reservation for a full refund of the deposit at any time before we place the parts order with our suppliers (see clause 2). After that point, amounts already invoiced reflect commitments we have made to our suppliers and are payable as set out in clause 3. Any variation to your order must be agreed in writing and may affect price and lead time.

11. Limitation of liability

To the maximum extent permitted by law, and subject to clause 9, Mexx is not liable for any indirect or consequential loss, loss of profit, loss of production, or loss of use, however arising in connection with the goods or services.

12. Governing law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the courts of that State.
